New York Court DENIES appeal of dismissal of Countrywide’s Foreclosure Complaint

Another victory FOR THE PEOPLE.

Yes, a New York Appeals court upheld the dismissal of a foreclosure granted to Countrywide because “Countrywide did not have standing”. 

Yes, Virginia, there is a Santa Clause Justice in some of our Courts. 

Standing has been the main issue of most foreclosure defenses and the lack of standing has been the biggest fraud the Plaintiff’s – banks, servicing companies, trustees and foreclosure mill attorneys – have been committing.

We have watched a handful of judges over the past few years stand up for standing.  Judge Boyko in Ohio, Judge Shack in New York, two of the first to do so.  Others in Ohio and New York have followed.  In Florida, the judges are not as ready to uphold the laws but we are seeing signs of that also changing.

Florida has modified its Statutes whereby a Plaintiff MUST prove their standing prior to filing a foreclosure action.  An Appellate Court in Florida also overturned a foreclosure for lack of standing and another Appellate Court has a case under consideration.
